How can we ask the state to intervene when, in fact, its armed forces have always practiced rape and battery against enemy women? In fact, sexual and intimate violence against women has been a central military tactic of war and domination<\/span><\/em><\/p>\n<p id=\"E543\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><em><span id=\"E544\" class=\"qowt-font8-Garamond\">Angela Davis<\/span><\/em><span id=\"E545\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 id=\"E551\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span style=\"color: #ff1764;\"><strong><span id=\"E552\" class=\"qowt-font8-Garamond\">Where We Are<\/span><\/strong><\/span><\/h3>\n<p id=\"E555\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E556\" class=\"qowt-font8-Garamond\">F<\/span><span id=\"E557\" class=\"qowt-font8-Garamond\">eminists in the <\/span><span id=\"E558\" class=\"qowt-font8-Garamond\">Spanish <\/span><span id=\"E559\" class=\"qowt-font8-Garamond\">S<\/span><span id=\"E560\" class=\"qowt-font8-Garamond\">tate<\/span><span id=\"E561\" class=\"qowt-font8-Garamond\"> have been immersed in a sort of hurricane that <\/span><span id=\"E562\" class=\"qowt-font8-Garamond\">never seems to<\/span><span id=\"E563\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E564\" class=\"qowt-font8-Garamond\">hit land <\/span><span id=\"E565\" class=\"qowt-font8-Garamond\">for several years<\/span><span id=\"E566\" class=\"qowt-font8-Garamond\">; or, to be more precise, since the so-called \u201cLa Manada\u201d case, a gang rape, in which the ensuing legal and media process catapulted <\/span><span id=\"E567\" class=\"qowt-font8-Garamond\">feminist movements<\/span><span id=\"E568\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E569\" class=\"qowt-font8-Garamond\">o<\/span><span id=\"E570\" class=\"qowt-font8-Garamond\">nto the streets.<\/span><span id=\"E571\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E573\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E574\" class=\"qowt-font8-Garamond\">There is a long genealogy of feminist struggle in the <\/span><span id=\"E575\" class=\"qowt-font8-Garamond\">Spanish State<\/span><span id=\"E576\" class=\"qowt-font8-Garamond\">, going back to the dictatorship and the period of the so-called transition <\/span><span id=\"E577\" class=\"qowt-font8-Garamond\">to democracy<\/span><span id=\"E578\" class=\"qowt-font8-Garamond\">, with moments of greater or lesser intensity. However, <\/span><span id=\"E579\" class=\"qowt-font8-Garamond\">here <\/span><span id=\"E580\" class=\"qowt-font8-Garamond\">we want to base our analysis on the more recent period\u2014the one we have lived through\u2014in order to raise questions <\/span><span id=\"E581\" class=\"qowt-font8-Garamond\">in search of<\/span><span id=\"E582\" class=\"qowt-font8-Garamond\">, as the title of this chapter indicates, a way out of the trap of punitivism.<\/span><span id=\"E583\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><\/p>\n<p id=\"E587\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E588\" class=\"qowt-font8-Garamond\">Like the meteorological phenomenon, we are in the center, in the eye of the hurricane, an apparently calm space, but surrounded by dense clouds <\/span><span id=\"E589\" class=\"qowt-font8-Garamond\">where<\/span><span id=\"E590\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E591\" class=\"qowt-font8-Garamond\">the strongest winds<\/span><span id=\"E592\" class=\"qowt-font8-Garamond\"> are found. Those dense clouds are the incessant media noise from which it seems that we cannot escape, a sort of <\/span><span id=\"E593\" class=\"qowt-font8-Garamond\">siege<\/span><span id=\"E594\" class=\"qowt-font8-Garamond\"> that, on the one hand, fuels the <\/span><span id=\"E595\" class=\"qowt-font8-Garamond\">media-based right wing<\/span><span id=\"E596\" class=\"qowt-font8-Garamond\"> and, on the other hand, is pushed by a feminism that flirts with punitive positions and <\/span><span id=\"E597\" class=\"qowt-font8-Garamond\">that<\/span><span id=\"E598\" class=\"qowt-font8-Garamond\">, curiously, is also transexclusive. <\/span><\/p>\n<p id=\"E601\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E602\" class=\"qowt-font8-Garamond\">Faced with<\/span><span id=\"E603\" class=\"qowt-font8-Garamond\"> this dead end of which, at times, there seemed to be no way out, we wanted to retrace our steps, look back, and ask ourselves what <\/span><span id=\"E604\" class=\"qowt-font8-Garamond\">was going on in the feminist movement when<\/span><span id=\"E605\" class=\"qowt-font8-Garamond\"> the La Manada gang rape occurred (Pamplona, July 2016). Furthermore, what was the context of the global feminist movement at the time? What autonomous feminist narratives emerged <\/span><span id=\"E606\" class=\"qowt-font8-Garamond\">from the context of La Manada case<\/span><span id=\"E607\" class=\"qowt-font8-Garamond\">? What <\/span><span id=\"E608\" class=\"qowt-font8-Garamond\">was<\/span><span id=\"E609\" class=\"qowt-font8-Garamond\"> the combative narrative that catalyzed feminist mobilizations between 2016 and 2020? What were the effects of the repression and criminalization of the movement <\/span><span id=\"E610\" class=\"qowt-font8-Garamond\">starting<\/span><span id=\"E611\" class=\"qowt-font8-Garamond\"> in the spring of 2020? In short, how did we get here? <\/span><span id=\"E612\" class=\"qowt-font8-Garamond\">A<\/span><span id=\"E613\" class=\"qowt-font8-Garamond\">bove all, how can we fight against impunity when it comes to sexist violence, while, at the same time, positioning ourselves against punitivism? We believe that the only way out of this difficult situation is through collective thought and dialogue among compa\u00f1eras, especially from a global perspective. <\/span><span id=\"E614\" class=\"qowt-font8-Garamond\">Toward <\/span><span id=\"E615\" class=\"qowt-font8-Garamond\">that end, this text enters into dialogue with the texts by compa\u00f1eras from La Laboratoria\u2019s other nodes <\/span>that are brought together in this publication.<\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E618\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E619\" class=\"qowt-font8-Garamond\">We will <\/span><span id=\"E620\" class=\"qowt-font8-Garamond\">trace<\/span><span id=\"E621\" class=\"qowt-font8-Garamond\"> a timeline <\/span><span id=\"E622\" class=\"qowt-font8-Garamond\">that allows<\/span><span id=\"E623\" class=\"qowt-font8-Garamond\"> us to follow the trail of the story and the feminist narratives that emerged in response to the patriarchal justice system, as shown during the investigation phase of the La Manada trial. We will also ask how, <\/span><span id=\"E624\" class=\"qowt-font8-Garamond\">after<\/span><span id=\"E625\" class=\"qowt-font8-Garamond\"> almost six years, the balance of powers has shifted once again to currently (at first glance) <\/span><span id=\"E626\" class=\"qowt-font8-Garamond\">favor<\/span><span id=\"E627\" class=\"qowt-font8-Garamond\"> a punitivist framework that is in line with the right wing media siege. We ask these questions in an attempt to find narratives that can help <\/span><span id=\"E628\" class=\"qowt-font8-Garamond\">rekindle <\/span><span id=\"E629\" class=\"qowt-font8-Garamond\">the capacity of autonomous feminist movements to make proposals and take the initiative.<\/span><span id=\"E630\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E631\" class=\"qowt-font8-Garamond\"> <\/span><\/p>\n<p id=\"E634\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E635\" class=\"qowt-font8-Garamond\">W<\/span><span id=\"E636\" class=\"qowt-font8-Garamond\">e will attempt to respond to these questions from the center of the <\/span><span id=\"E637\" class=\"qowt-font8-Garamond\">storm<\/span><span id=\"E638\" class=\"qowt-font8-Garamond\">, that is, from our lived experience as feminist activists close to the 8M Commission of Madrid\u2019s feminist movement. We believe, as Gloria Anzald\u00faa said, we are from where we think and, conversely, we think from where we are. Therefore, <\/span><span id=\"E639\" class=\"qowt-font8-Garamond\">in assembling<\/span><span id=\"E640\" class=\"qowt-font8-Garamond\"> this text, we have turned to dialogue among compa\u00f1eras, to sharing memories and reflections, and to the multiple materials <\/span><span id=\"E641\" class=\"qowt-font8-Garamond\">directly <\/span><span id=\"E642\" class=\"qowt-font8-Garamond\">published by the 8M Commission, which are like a heart rate monitor, reading the pulse of the movement<\/span><span id=\"E643\" class=\"qowt-font8-Garamond\">. <\/span><\/p>\n<p id=\"E646\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E647\" class=\"qowt-font8-Garamond\">We will attempt to review the narratives that circulated between the autumn of 2017, when the first feminist mobilizations occurred shouting \u201cI believe you\u201d and \u201cYou are not alone\u201d while the trial was taking place in the Provincial Court of Navarra, to the <\/span><span id=\"E648\" class=\"qowt-font8-Garamond\">passing of the <\/span><span id=\"E649\" class=\"qowt-font8-Garamond\">Law on the Comprehensive Guarantee of Sexual Freedom<\/span><span id=\"E650\" class=\"qowt-font8-Garamond\"> 10\/2022, known as the \u201cOnly Yes is Yes\u201d Law. We will find two constant voices that intersect, most of the time in opposition to one another: that of the autonomous feminist movement and that of the media. There are <\/span><span id=\"E651\" class=\"qowt-font8-Garamond\">ebbs and flows<\/span><span id=\"E652\" class=\"qowt-font8-Garamond\"> in the dispute over the narrative; at times, the feminist movement has an unstoppable rhetorical force and, at others, as we will see, the media manages to corner the movement. <\/span><\/p>\n<p id=\"E655\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E656\" class=\"qowt-font8-Garamond\">For us, <\/span><span id=\"E657\" class=\"qowt-font8-Garamond\">there is a clear logic<\/span><span id=\"E658\" class=\"qowt-font8-Garamond\">, although it can be complicated to follow. Between 2014 and 2017, there <\/span><span id=\"E659\" class=\"qowt-font8-Garamond\">is<\/span><span id=\"E660\" class=\"qowt-font8-Garamond\"> a strong, organized, and global feminist movement, <\/span><span id=\"E661\" class=\"qowt-font8-Garamond\">that had an enormous capacity to mobilize people in the streets and online<\/span><span id=\"E662\" class=\"qowt-font8-Garamond\">. <\/span><span id=\"E663\" class=\"qowt-font8-Garamond\">The presence of feminism on the streets has been growing in our territory<\/span><span id=\"E664\" class=\"qowt-font8-Garamond\">, with huge protests for the right to abortion, against cuts to public services, and in solidarity with the situation of women in Nicaragua and El Salvador, which ended with the resignation of the then minister Alberto Ruiz-Gallard\u00f3n (September, 2014). There have also been mobilizations against sexist violence and the 8M Commission <\/span><span id=\"E665\" class=\"qowt-font8-Garamond\">is<\/span><span id=\"E666\" class=\"qowt-font8-Garamond\"> already working intensely on what will be the international feminist strike and next large demonstration on March 8, 2018. <\/span><\/p>\n<p id=\"E669\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E670\" class=\"qowt-font8-Garamond\">This is the context when<\/span><span id=\"E671\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E672\" class=\"qowt-font8-Garamond\">the<\/span><span id=\"E673\" class=\"qowt-font8-Garamond\"> La Manada case hits the media. <\/span><span id=\"E674\" class=\"qowt-font8-Garamond\">O<\/span><span id=\"E675\" class=\"qowt-font8-Garamond\">n July 7, 2016, a gang rape is committed during the patron saint festivities (San Ferm<\/span><span id=\"E676\" class=\"qowt-font8-Garamond\">\u00edn <\/span><span id=\"E677\" class=\"qowt-font8-Garamond\">festival) of the Navarrese city of Iru\u00f1ea (Pamplona). Five <\/span><span id=\"E678\" class=\"qowt-font8-Garamond\">men<\/span><span id=\"E679\" class=\"qowt-font8-Garamond\">, some of whom belong to the state security forces, and who share a group chat called \u201cLa Manada\u201d (\u201cwolf pack\u201d) (hence the name with which the case is baptized), rape an eighteen year old girl in a doorway. They record it and then steal <\/span><span id=\"E680\" class=\"qowt-font8-Garamond\">the victim\u2019s<\/span><span id=\"E681\" class=\"qowt-font8-Garamond\"> cellphone so that she cannot report it.<\/span><\/p>\n<p id=\"E684\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E685\" class=\"qowt-font8-Garamond\">The media attempts to construct a narrative based on the logic of sexual terror, but they <\/span><span id=\"E686\" class=\"qowt-font8-Garamond\">are unsuccessful in making it seep into public opinion<\/span><span id=\"E687\" class=\"qowt-font8-Garamond\">: the feminist movement puts a stop to it, placing bodies <\/span><span id=\"E688\" class=\"qowt-font8-Garamond\">on<\/span><span id=\"E689\" class=\"qowt-font8-Garamond\"> the streets, speaking of rape and the patriarchal justice system, and <\/span><span class=\"qowt-font8-Garamond\">confronting the patriarchal <\/span><span id=\"E690\" class=\"qowt-font8-Garamond\">backlash as it begins<\/span><span id=\"E691\" class=\"qowt-font8-Garamond\">. With the <\/span><span id=\"E692\" class=\"qowt-font8-Garamond\">case<\/span><span id=\"E693\" class=\"qowt-font8-Garamond\"> still open, the institutional context changes: in 2018, a motion of censure against the then president Mariano Rajoy puts an end to the Partido Popular\u2019s <\/span><span id=\"E694\" class=\"qowt-font8-Garamond\">[People\u2019s Party]<\/span><span id=\"E695\" class=\"qowt-font8-Garamond\"> Government. After a brief interlude of uncertainty, at the beginning of 2022, the Partido Socialista <\/span><span id=\"E696\" class=\"qowt-font8-Garamond\">[Socialist Party]<\/span><span id=\"E697\" class=\"qowt-font8-Garamond\"> and Unidas Podemos <\/span><span id=\"E698\" class=\"qowt-font8-Garamond\">[United We Can] <\/span><span id=\"E699\" class=\"qowt-font8-Garamond\">form a coalition government. In turn, a patriarchal offensive is launched from the right that <\/span><span id=\"E700\" class=\"qowt-font8-Garamond\">has also been able to channel itself into different institutional fields. The COVID-19 pandemic is used to criminalize the feminist movement, which is accused of contributing to the spread of the virus by calling <\/span><span id=\"E701\" class=\"qowt-font8-Garamond\">a<\/span><span id=\"E702\" class=\"qowt-font8-Garamond\"> massive demonstration <\/span><span id=\"E703\" class=\"qowt-font8-Garamond\">for International Working Women\u2019s Day <\/span><span id=\"E704\" class=\"qowt-font8-Garamond\">on March 8, 2020. This, combined with the emptying of the streets due to quarantine measures, causes public opinion to start to lean toward the narrative of the <\/span><span id=\"E705\" class=\"qowt-font8-Garamond\">media right<\/span><span id=\"E706\" class=\"qowt-font8-Garamond\">. A confrontation and later rupture within the feminist movement plays an important role in this process of criminalization and marginalization. This <\/span><span id=\"E707\" class=\"qowt-font8-Garamond\">conflict <\/span><span id=\"E708\" class=\"qowt-font8-Garamond\">initially revolved around the debate over prostitution and the recognition of sex workers\u2019 rights, but intensified when a group of very powerful women close to the <\/span><span id=\"E709\" class=\"qowt-font8-Garamond\">Partido Socialista<\/span><span id=\"E710\" class=\"qowt-font8-Garamond\"> started to belligerently demand that trans women be excluded from the feminist movement.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E713\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E714\" class=\"qowt-font8-Garamond\">This is the thread of events that we will attempt to unravel in what follows in order to summon feminist <\/span><span id=\"E715\" class=\"qowt-font8-Garamond\">power<\/span><span id=\"E716\" class=\"qowt-font8-Garamond\"> and look for ways out of the current quagmire.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 id=\"E719\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E720\" class=\"qowt-font8-Garamond\" style=\"color: #ff1764;\">2017-2020: Feminist Power<\/span><\/h3>\n<p id=\"E723\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E724\" class=\"qowt-font8-Garamond\">I<\/span><span id=\"E725\" class=\"qowt-font8-Garamond\">n the autumn of 2017, <\/span><span id=\"E726\" class=\"qowt-font8-Garamond\">as<\/span><span id=\"E727\" class=\"qowt-font8-Garamond\"> the first oral hearing in the La Manada trial is set to start, <\/span><span id=\"E728\" class=\"qowt-font8-Garamond\">feminists<\/span><span id=\"E729\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E730\" class=\"qowt-font8-Garamond\">find<\/span><span id=\"E731\" class=\"qowt-font8-Garamond\"> ourselves in streets across Spain protesting to the cry of \u201cSister, here is your pack!\u201d We <\/span><span id=\"E732\" class=\"qowt-font8-Garamond\">know<\/span><span id=\"E733\" class=\"qowt-font8-Garamond\"> that we <\/span><span id=\"E734\" class=\"qowt-font8-Garamond\">are<\/span><span id=\"E735\" class=\"qowt-font8-Garamond\"> not alone: feminisms <\/span><span id=\"E736\" class=\"qowt-font8-Garamond\">have been setting the pace for social movements at the international scale for some time now. We have broken silences. We have identified and named violences. We have made slogans circulate globally. We are coming from the large Argentine and Latin American mobilizations under the slogan \u201cNi Una Menos\u201d [Not One Woman Less], the national strikes in October 2016 repudiating the feminicide of Luc\u00eda P\u00e9rez, struggles for the decriminalization of the voluntary interruption of pregnancy from Poland to Argentina. <\/span><\/p>\n<p id=\"E739\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E740\" class=\"qowt-font8-Garamond\">In the Spanish <\/span><span id=\"E741\" class=\"qowt-font8-Garamond\">S<\/span><span id=\"E742\" class=\"qowt-font8-Garamond\">tate, we are immersed in <\/span><span id=\"E743\" class=\"qowt-font8-Garamond\">preparing<\/span><span id=\"E744\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E745\" class=\"qowt-font8-Garamond\">for <\/span><span id=\"E746\" class=\"qowt-font8-Garamond\">the feminist strike <\/span><span id=\"E747\" class=\"qowt-font8-Garamond\">in<\/span><span id=\"E748\" class=\"qowt-font8-Garamond\"> March 2018, in which denouncing violences plays an important role. We also have #MeToo in the United States (hashtag <\/span><span id=\"E749\" class=\"qowt-font8-Garamond\">from<\/span><span id=\"E750\" class=\"qowt-font8-Garamond\"> 2017) and the more local #Cu\u00e9ntalo [\u201cTell your story\u201d], started by the journalist Cristina Fallar\u00e1s (hashtag from 2018). Both of these make up part of an international wave that <\/span><span id=\"E751\" class=\"qowt-font8-Garamond\">originated in<\/span><span id=\"E752\" class=\"qowt-font8-Garamond\"> the Global South and connects with mobilizations here, bringing to light and naming all the forms of violence that affect <\/span><span id=\"E753\" class=\"qowt-font8-Garamond\">us women from the moment our bodies are read as such.<\/span><span id=\"E754\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E756\" class=\"qowt-font8-Garamond\"> These campaigns demonstrate a rupturing of individual silences to illuminate structural violence and lay out a collective response.<\/span><span id=\"E757\" class=\"qowt-font8-Garamond\"> <\/span><\/p>\n<p id=\"E760\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E761\" class=\"qowt-font8-Garamond\">On the patriarchal front, on the other hand, the <\/span><span id=\"E762\" class=\"qowt-font8-Garamond\">backlash<\/span><span id=\"E763\" class=\"qowt-font8-Garamond\"> is already heating up with transphobic, racist, and anti-feminist discourses, such as those of the far right association Hazte O\u00edr, which warns of \u201ca war of the sexes\u201d and claims to stand up to \u201cindoctrination\u201d and against \u201cgender ideology.\u201d<\/span><span id=\"E764\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E766\" class=\"qowt-font8-Garamond\"> Thus, they <\/span><span id=\"E767\" class=\"qowt-font8-Garamond\">lay out an argument<\/span><span id=\"E768\" class=\"qowt-font8-Garamond\"> that will later be <\/span><span id=\"E769\" class=\"qowt-font8-Garamond\">picked up<\/span><span id=\"E770\" class=\"qowt-font8-Garamond\"> by <\/span><span id=\"E771\" class=\"qowt-font8-Garamond\">unexpected<\/span><span id=\"E772\" class=\"qowt-font8-Garamond\"> actors (and actresses). <\/span><\/p>\n<p id=\"E775\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E776\" class=\"qowt-font8-Garamond\">These <\/span><span id=\"E777\" class=\"qowt-font8-Garamond\">turbulent waters are the setting for<\/span><span id=\"E778\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E779\" class=\"qowt-font8-Garamond\">the legal proceedings that go<\/span><span id=\"E780\" class=\"qowt-font8-Garamond\"> from July 2016, <\/span><span class=\"qowt-font8-Garamond\">when the La Manada rape takes place, to June 2019, when <\/span><span id=\"E781\" class=\"qowt-font8-Garamond\">the Supreme Court\u2019s ruling is published.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E784\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E785\" class=\"qowt-font8-Garamond\">With the context in place, let\u2019s take a closer look <\/span><span id=\"E786\" class=\"qowt-font8-Garamond\">at how these events unfolded<\/span><span id=\"E787\" class=\"qowt-font8-Garamond\"> and, especially, the narrative battle that revolved around sexual violence and meanings of justice.<\/span><\/p>\n<p id=\"E790\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E791\" class=\"qowt-font8-Garamond\">N<\/span><span id=\"E792\" class=\"qowt-font8-Garamond\">ews of the gang rape <\/span><span id=\"E793\" class=\"qowt-font8-Garamond\">reached<\/span><span id=\"E794\" class=\"qowt-font8-Garamond\"> public opinion from day one. The <\/span><span id=\"E795\" class=\"qowt-font8-Garamond\">m<\/span><span id=\"E796\" class=\"qowt-font8-Garamond\">ainstream media initially reacts by questioning the seriousness of the accusation: It is a rape? It is a \u201cpornographic fantasy?\u201d Is it \u201ceuphoria and revelry\u201d (as the dissenting opinion of one of the members of the Court will reflect)? <\/span><span id=\"E797\" class=\"qowt-font8-Garamond\">The media<\/span><span id=\"E798\" class=\"qowt-font8-Garamond\"> do<\/span><span id=\"E799\" class=\"qowt-font8-Garamond\">es<\/span><span id=\"E800\" class=\"qowt-font8-Garamond\"> not miss <\/span><span id=\"E801\" class=\"qowt-font8-Garamond\">a<\/span><span id=\"E802\" class=\"qowt-font8-Garamond\"> chance to highlight that the attacked woman does not fit the image of the perfect victim: \u201cShe didn\u2019t resist,\u201d \u201cShe is going on with her life,\u201d etc. Thus, a true media circus begins, which is devastating for the victim and for all women, in which the lawyer for and relatives of members of La Manada parade through television programs, putting the focus on the victim, blaming her, and trying to sow doubt over what happened. <\/span><\/p>\n<p id=\"E805\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E806\" class=\"qowt-font8-Garamond\">However, none of this catches the feminist movement in Iru\u00f1\u00e9 <\/span><span id=\"E807\" class=\"qowt-font8-Garamond\">off guard<\/span><span id=\"E808\" class=\"qowt-font8-Garamond\">: it has been mobilizing against <\/span><span id=\"E809\" class=\"qowt-font8-Garamond\">multiple forms of violence<\/span><span id=\"E810\" class=\"qowt-font8-Garamond\"> for years, warning of the sexual and sexist violence in the San Ferm<\/span><span id=\"E811\" class=\"qowt-font8-Garamond\">\u00ed<\/span><span id=\"E812\" class=\"qowt-font8-Garamond\">n <\/span><span id=\"E813\" class=\"qowt-font8-Garamond\">festival<\/span><span id=\"E814\" class=\"qowt-font8-Garamond\">, calling for festivities free of sexist aggression, forcing the City Council to establish information points across the city and to create an action program. In the months immediately following the attack, <\/span><span id=\"E815\" class=\"qowt-font8-Garamond\">the movement<\/span><span id=\"E816\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E817\" class=\"qowt-font8-Garamond\">connects<\/span><span id=\"E818\" class=\"qowt-font8-Garamond\"> what happened in that doorway <\/span><span id=\"E819\" class=\"qowt-font8-Garamond\">to<\/span><span id=\"E820\" class=\"qowt-font8-Garamond\"> other cases, including that of Nagore Laffage, who was attacked and murdered, at twenty years of age, in the 2008 San Ferm<\/span><span id=\"E821\" class=\"qowt-font8-Garamond\">\u00ed<\/span><span id=\"E822\" class=\"qowt-font8-Garamond\">n <\/span><span id=\"E823\" class=\"qowt-font8-Garamond\">festival<\/span><span id=\"E824\" class=\"qowt-font8-Garamond\">. <\/span><span id=\"E825\" class=\"qowt-font8-Garamond\">The movement<\/span><span id=\"E826\" class=\"qowt-font8-Garamond\"> puts energy into rendering structural elements visible, calling attention not only to a sexist culture in which a woman in public space is seen to belong to everyone, but also targeting the patriarchal justice system that denies and minimizes violence. <\/span><\/p>\n<p id=\"E829\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E830\" class=\"qowt-font8-Garamond\">The main struggle during this phase is <\/span><span id=\"E831\" class=\"qowt-font8-Garamond\">to be \u201cbelieved,<\/span><span id=\"E832\" class=\"qowt-font8-Garamond\">\u201d <\/span><span id=\"E833\" class=\"qowt-font8-Garamond\">as<\/span><span id=\"E834\" class=\"qowt-font8-Garamond\"> it is obvious that we are being raped and killed, and, even so, the veracity of accusations are being called into question. Thus, <\/span><span id=\"E835\" class=\"qowt-font8-Garamond\">a slogan arises<\/span><span id=\"E836\" class=\"qowt-font8-Garamond\"> that immediately <\/span><span id=\"E837\" class=\"qowt-font8-Garamond\">has popular appeal<\/span><span id=\"E838\" class=\"qowt-font8-Garamond\">, while, at the same time, coming from decades of struggle against sexual violence by autonomous feminism movements in the Spanish <\/span><span id=\"E839\" class=\"qowt-font8-Garamond\">S<\/span><span id=\"E840\" class=\"qowt-font8-Garamond\">tate: \u201cI believe you.\u201d<\/span><\/p>\n<p id=\"E843\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E844\" class=\"qowt-font8-Garamond\">In the days leading up<\/span><span id=\"E845\" class=\"qowt-font8-Garamond\"> to the trial (November 13, 2017), <\/span><span id=\"E846\" class=\"qowt-font8-Garamond\">after<\/span><span id=\"E847\" class=\"qowt-font8-Garamond\"> months of media silence, the excitement returns. Two facts dominate the media narrative. <\/span><span id=\"E848\" class=\"qowt-font8-Garamond\">O<\/span><span id=\"E849\" class=\"qowt-font8-Garamond\">n the one hand, the judiciary accepts the report made by a private detective, hired by La Manada\u2019s defense, to snoop into the victim\u2019s private life. <\/span><span id=\"E850\" class=\"qowt-font8-Garamond\">O<\/span><span id=\"E851\" class=\"qowt-font8-Garamond\">n the other hand, <\/span><span id=\"E852\" class=\"qowt-font8-Garamond\">it<\/span><span id=\"E853\" class=\"qowt-font8-Garamond\"> does not admit into evidence the Whatsapp group messages of the accused in which they acknowledge their taste for gang rapes nor those in which they refer to another sexual assault carried out in the Torrecampo (C\u00f3rdoba) festivities, despite the fact that they reveal a clear pattern of behavior on the part of the accused, as well as their sense of impunity and how accustomed they are to not having to answer for their actions. Meanwhile, the <\/span><span id=\"E854\" class=\"qowt-font8-Garamond\">media right<\/span><span id=\"E855\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E856\" class=\"qowt-font8-Garamond\">is <\/span><span id=\"E857\" class=\"qowt-font8-Garamond\">starting to lay out<\/span><span id=\"E858\" class=\"qowt-font8-Garamond\"> the discourse of revictimization and <\/span><span id=\"E859\" class=\"qowt-font8-Garamond\">victim blaming<\/span><span id=\"E860\" class=\"qowt-font8-Garamond\"> (\u201cthis is what happens if you drink and go to <\/span><span id=\"E861\" class=\"qowt-font8-Garamond\">festivals<\/span><span id=\"E862\" class=\"qowt-font8-Garamond\"> alone\u201d). Rage floods the streets, social media, in-person and virtual conversations, feminist assemblies in neighborhoods, towns, and cities. <\/span><\/p>\n<p id=\"E865\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E866\" class=\"qowt-font8-Garamond\">The trial in the Provincial Court of Navarra starts in this atmosphere of indignation, with a strong autonomous feminist movement <\/span><span id=\"E867\" class=\"qowt-font8-Garamond\">already <\/span><span id=\"E868\" class=\"qowt-font8-Garamond\">organized at the state level around the <\/span><span id=\"E869\" class=\"qowt-font8-Garamond\">call <\/span><span class=\"qowt-font8-Garamond\">for a<\/span><span id=\"E870\" class=\"qowt-font8-Garamond\"> feminist strike a few months later. <\/span><span id=\"E871\" class=\"qowt-font8-Garamond\">The movement has muscle<\/span><span id=\"E872\" class=\"qowt-font8-Garamond\"> and demonstrations of strength take place both in the streets, with massive <\/span><span id=\"E873\" class=\"qowt-font8-Garamond\">protests<\/span><span id=\"E874\" class=\"qowt-font8-Garamond\">, and in the narrative. Not only does the movement call out the patriarchal bias of judicial decisions, but also the social alarm generated by the media (<\/span><span id=\"E875\" class=\"qowt-font8-Garamond\">sexual terror<\/span><span id=\"E876\" class=\"qowt-font8-Garamond\">), the way the victim is put on tr<\/span><span id=\"E877\" class=\"qowt-font8-Garamond\">ial<\/span><span id=\"E878\" class=\"qowt-font8-Garamond\">, and the sensationalist language used in <\/span><span id=\"E879\" class=\"qowt-font8-Garamond\">most<\/span><span id=\"E880\" class=\"qowt-font8-Garamond\"> radio and television talk shows.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E883\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E884\" class=\"qowt-font8-Garamond\">Social media <\/span><span id=\"E885\" class=\"qowt-font8-Garamond\">is used<\/span><span id=\"E886\" class=\"qowt-font8-Garamond\"> to dispute the media\u2019s coverage. There is a high level of critique of <\/span><span id=\"E887\" class=\"qowt-font8-Garamond\">the mainstream media<\/span><span id=\"E888\" class=\"qowt-font8-Garamond\"> narrative, pointing out and disapproving of the headlines <\/span><span id=\"E889\" class=\"qowt-font8-Garamond\">in<\/span><span id=\"E890\" class=\"qowt-font8-Garamond\"> major newspapers. Public opinion, expressed in Twitter and Instagram, situates sexual violence and patriarchal justice among its main concerns and the media as part of the problem. However, it is in the street, a place more prone to anger, where the strongest chants in support women and the harshest against the judiciary, the accused, and, more generally, against sexist violence and those responsible for it, can be heard: <\/span><span id=\"E891\" class=\"qowt-font8-Garamond\">\u201c<\/span><span id=\"E892\" class=\"qowt-font8-Garamond\">Shitty justice system<\/span><span id=\"E893\" class=\"qowt-font8-Garamond\">, you\u2019re judging her,\u201d \u201cSexist idiot, your mouth is on the curb,\u201d \u201cFear is going to change sides,\u201d \u201cAlone and drunk, I still want to <\/span><span id=\"E894\" class=\"qowt-font8-Garamond\">make it<\/span><span id=\"E895\" class=\"qowt-font8-Garamond\"> home,\u201d \u201cDon\u2019t worry sister, your pack is here,\u201d \u201cI believe you.\u201d <\/span><\/p>\n<p id=\"E898\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E899\" class=\"qowt-font8-Garamond\">In the midst of this turmoil, we learn the outcome of a feminicide that is <\/span><span id=\"E900\" class=\"qowt-font8-Garamond\">often linked to <\/span><span id=\"E901\" class=\"qowt-font8-Garamond\">the<\/span><span id=\"E902\" class=\"qowt-font8-Garamond\"> La Manada case. <\/span><span id=\"E903\" class=\"qowt-font8-Garamond\">T<\/span><span id=\"E904\" class=\"qowt-font8-Garamond\">he lifeless body of Diana Quer <\/span><span id=\"E905\" class=\"qowt-font8-Garamond\">appeared on December 31, 2017<\/span><span id=\"E906\" class=\"qowt-font8-Garamond\">. More than a year earlier, Jos\u00e9 Enrique Abu\u00edn had kidnapped her and tried to sexual assault her, <\/span><span id=\"E907\" class=\"qowt-font8-Garamond\">before finally killing her. <\/span><span id=\"E908\" class=\"qowt-font8-Garamond\">That year<\/span><span id=\"E909\" class=\"qowt-font8-Garamond\"> also marks the twenty-fifth anniversary of the most significant and disciplinary cases of sexual violence in the Spanish state: the kidnapping, rape, and murder of three teenagers, aged fourteen and fifteen, known as the Alc\u00e0sser crime. The media indulges in sensationalism, fueling the discourse of sexual terror, at the same time as it echoes the punitivist discourse of Diana Quer\u2019s father, a strident defender of life sentences. Faced with all of this, the feminist movement <\/span><span id=\"E910\" class=\"qowt-font8-Garamond\">continues to focus on<\/span><span id=\"E911\" class=\"qowt-font8-Garamond\"> critiquing the judicial and media systems, at the same time as it creates its own languages and mechanisms to combat sexist violence and aggression: reinforcing and creating new purple points<\/span><span id=\"E912\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E914\" class=\"qowt-font8-Garamond\"> in neighborhood and town festivals, encouraging women on social media to recount the aggression that we have all survived, promoting feminist self-defense, insisting on sex-affective education, launching the hashtag #AlertaFeminista <\/span><span id=\"E915\" class=\"qowt-font8-Garamond\">[#FeministAlert]<\/span><span id=\"E916\" class=\"qowt-font8-Garamond\">.<\/span><\/p>\n<p id=\"E919\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E920\" class=\"qowt-font8-Garamond\">On April 26, 2018, the Provincial Court of Navarra <\/span><span id=\"E921\" class=\"qowt-font8-Garamond\">releases<\/span><span id=\"E922\" class=\"qowt-font8-Garamond\"> its verdict: it has not found \u201csigns of violence or intimidation\u201d in the rape perpetrated by five adult men against an eighteen year old woman cornered in a doorway, therefore, applying the law, <\/span><span id=\"E923\" class=\"qowt-font8-Garamond\">the men<\/span><span id=\"E924\" class=\"qowt-font8-Garamond\"> are not convicted of sexual assault, but only of abuse. Thousands of feminists flood the streets and social media with indignation and rage. The movement is brimming with <\/span><span id=\"E925\" class=\"qowt-font8-Garamond\">vitality<\/span><span id=\"E926\" class=\"qowt-font8-Garamond\">: it has just made history, with a general feminist\u2014care, labor, consumer, student\u2014strike, the first of its kind in the Spanish State, supported by nearly six million women workers and crowned by the largest feminist demonstrations in memory. There are multiple, undeniable synergies and continuities between the overwhelming force of this strike and the massive mobilizations in the month April protesting the La Manada ruling. In both mobilizations, issues regarding care, social reproduction, and labor conditions are intertwined with those of sexual violence against women. One of the most chanted slogans in April is \u201cNo is no, everything else is rape,\u201d seed of the later \u201cOnly yes is yes.\u201d It is thanks to organized feminism, then, that consent is placed in the center.<\/span><\/p>\n<p id=\"E929\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E930\" class=\"qowt-font8-Garamond\">There are, of course, paradoxes and chiaroscuros: there is not an equally strong response to <\/span><span class=\"qowt-font8-Garamond\">sexual assault in every case. A few days after the sentence for La Manada in the Navarra Provincial Court is released, two German journalists publish a report that refers to rapes and sexual assaults in the strawberry fields of Huelva, which generates a scandal in Germany.<\/span><span id=\"E931\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E933\" class=\"qowt-font8-Garamond\"> In the midst of an atmosphere of tension between Spanish agricultural exporters and large German food distributors, a new case comes out in the media: several female day laborers, Morrocan migrants, <\/span><span id=\"E934\" class=\"qowt-font8-Garamond\">contracted in their country of origin,<\/span><span id=\"E935\" class=\"qowt-font8-Garamond\"> denounce, before the Civil Guard, the person responsible for a strawberry production in Almonte for sexual assault and labor abuses.<\/span><span id=\"E936\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E938\" class=\"qowt-font8-Garamond\"> From Huelva, different associations call for a reaction <\/span><span id=\"E939\" class=\"qowt-font8-Garamond\">against this <\/span><span id=\"E940\" class=\"qowt-font8-Garamond\">intertwining of patriarchal violence, labor exploitation, and racism in the bodies of women who experience a situation of extreme precarity and dispossession, reinforced by the <\/span><span id=\"E941\" class=\"qowt-font8-Garamond\">Law on Foreign Persons<\/span><span id=\"E942\" class=\"qowt-font8-Garamond\">. On June 17, 2018, a large demonstration <\/span><span id=\"E943\" class=\"qowt-font8-Garamond\">called<\/span><span id=\"E944\" class=\"qowt-font8-Garamond\"> by union, social, and feminist organizations traverses the streets of Huelva, with a banner that reads: \u201cNeither labor slavery nor sexual slavery. Work, yes, but with rights.\u201d<\/span><span id=\"E945\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E947\" class=\"qowt-font8-Garamond\"> However, in other cities, the call receives only a lukewarm response from a feminist movement that is very mobilized for the La Manada case. Antiracist feminism organizations will issue an intense questioning of the movement as a whole, asking about the limits of sisterhood. It is in this context that the <\/span><span id=\"E948\" class=\"qowt-font8-Garamond\">Asociaci\u00f3n Jornaleras de Huelva en Lucha <\/span><span id=\"E949\" class=\"qowt-font8-Garamond\">[the Association of Women Day Labors of Huelva in Struggle] <\/span><span id=\"E950\" class=\"qowt-font8-Garamond\">is founded.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E954\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E955\" class=\"qowt-font8-Garamond\">Despite the shortcomings, which <\/span><span id=\"E956\" class=\"qowt-font8-Garamond\">will<\/span><span id=\"E957\" class=\"qowt-font8-Garamond\"> generate painful debates, <\/span><span id=\"E958\" class=\"qowt-font8-Garamond\">as well as<\/span><span id=\"E959\" class=\"qowt-font8-Garamond\"> awareness of the vital and urgent need to strengthen antiracism within the heart of the feminist movement, this intense politicization of sexual violence <\/span><span id=\"E960\" class=\"qowt-font8-Garamond\">imprints a shift<\/span><span id=\"E961\" class=\"qowt-font8-Garamond\"> on the attitude and discourse of the mainstream media. The <\/span><span id=\"E962\" class=\"qowt-font8-Garamond\">vitality<\/span><span id=\"E963\" class=\"qowt-font8-Garamond\"> of the mobilizations is compounded by the active role and position of <\/span><span id=\"E964\" class=\"qowt-font8-Garamond\">female<\/span><span id=\"E965\" class=\"qowt-font8-Garamond\"> journalists and the <\/span><span id=\"E966\" class=\"qowt-font8-Garamond\">tireless work of hundreds of grassroots activists who have pushed the major outlets to include explicitly feminist voices. Madrid\u2019s 8M Commission and its different working groups (press group, outreach group, neighborhood and town groups) have been carrying out extraordinary work to ensure that the feminist argument reaches every newsroom and every household.<\/span><span id=\"E967\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><\/p>\n<p id=\"E971\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E972\" class=\"qowt-font8-Garamond\">Specifically, in regards to the La Manada case, <\/span><span id=\"E973\" class=\"qowt-font8-Garamond\">there are three <\/span><span id=\"E974\" class=\"qowt-font8-Garamond\">elements to the feminist movement\u2019s argument<\/span><span id=\"E975\" class=\"qowt-font8-Garamond\">: 1) <\/span><span id=\"E976\" class=\"qowt-font8-Garamond\">challenging <\/span><span id=\"E977\" class=\"qowt-font8-Garamond\">a patriarchal justice system that neither believes nor protects women and that legitimizes sexist violence; 2) <\/span><span id=\"E978\" class=\"qowt-font8-Garamond\">focusing<\/span><span id=\"E979\" class=\"qowt-font8-Garamond\"> on the structural character of the acts: understanding that what lies at the heart of sexual violence and <\/span><span id=\"E980\" class=\"qowt-font8-Garamond\">how<\/span><span id=\"E981\" class=\"qowt-font8-Garamond\"> it is socially and legally addressed is an attack on women\u2019s freedom; and 3) prioritizing preventative action (transversal sexual education) and protection. It is important to <\/span><span id=\"E982\" class=\"qowt-font8-Garamond\">emphasize<\/span><span id=\"E983\" class=\"qowt-font8-Garamond\"> that, in no moment, has the autonomous feminist movement spoken of sentences or prison; to the contrary, <\/span><span id=\"E984\" class=\"qowt-font8-Garamond\">as<\/span><span id=\"E985\" class=\"qowt-font8-Garamond\"> Diana Quer\u2019s father is <\/span><span id=\"E986\" class=\"qowt-font8-Garamond\">calling for a life prison sentence with review, the feminism <\/span><span id=\"E987\" class=\"qowt-font8-Garamond\">building<\/span><span id=\"E988\" class=\"qowt-font8-Garamond\"> the feminist strikes wagers on a radical change both of society and of the established system. On the strictly legal plane, this feminist movement argues that the judicial system must be transformed in order to ensure that the needs of women <\/span><span id=\"E989\" class=\"qowt-font8-Garamond\">reporting assaults<\/span><span id=\"E990\" class=\"qowt-font8-Garamond\"> are met, that <\/span><span id=\"E991\" class=\"qowt-font8-Garamond\">they<\/span><span id=\"E992\" class=\"qowt-font8-Garamond\"> have access to all the necessary resources, that procedures are fair and do not revictimize women, and that protection measures are effective in all cases. <\/span><span id=\"E993\" class=\"qowt-font8-Garamond\"> <\/span><\/p>\n<p id=\"E996\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E997\" class=\"qowt-font8-Garamond\">Meanwhile, the <\/span><span id=\"E998\" class=\"qowt-font8-Garamond\">case<\/span><span id=\"E999\" class=\"qowt-font8-Garamond\"> continues. On December 5, 2018, through an appeal, the High Court of Navarra confirms the sentence of nine years for sexual abuse. The feminist movement returns to the streets once again to accuse the justice system of being sexist. <\/span><span id=\"E1000\" class=\"qowt-font8-Garamond\">Feminists<\/span><span id=\"E1001\" class=\"qowt-font8-Garamond\"> are not protesting the nine years of the sentence, but rather how the crime is classified: the judges suppose that, for an act be considered rape, the victim <\/span><span id=\"E1002\" class=\"qowt-font8-Garamond\">must<\/span><span id=\"E1003\" class=\"qowt-font8-Garamond\"> demonstrate that she <\/span><span class=\"qowt-font8-Garamond\">put up resistance. <\/span><span id=\"E1004\" class=\"qowt-font8-Garamond\">Protesters, then,<\/span><span id=\"E1005\" class=\"qowt-font8-Garamond\"> are not asking for more years in prison for the perpetrators, but rather, they are challenging <\/span><span id=\"E1006\" class=\"qowt-font8-Garamond\">how<\/span><span id=\"E1007\" class=\"qowt-font8-Garamond\"> the<\/span><span id=\"E1008\" class=\"qowt-font8-Garamond\"> justice system blames the victim<\/span><span id=\"E1009\" class=\"qowt-font8-Garamond\">. Their focus is on eliminating the need to show \u201cproof of violence or intimidation\u201d for a sexual act carried out without the other person\u2019s explicit consent to be judge<\/span><span id=\"E1010\" class=\"qowt-font8-Garamond\">d<\/span><span id=\"E1011\" class=\"qowt-font8-Garamond\"> as sexual assault. This argument contains the seed of what will be the Organic Law of the Comprehensive Guarantee to Sexual Freedom, <\/span><span id=\"E1012\" class=\"qowt-font8-Garamond\">which<\/span><span id=\"E1013\" class=\"qowt-font8-Garamond\"> will go into effect in October 2022. On the way, organized feminism will experience intense criminalization orchestrated by the <\/span><span id=\"E1014\" class=\"qowt-font8-Garamond\">media right<\/span><span id=\"E1015\" class=\"qowt-font8-Garamond\">. But let\u2019s not get ahead of ourselves.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E1018\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1019\" class=\"qowt-font8-Garamond\">On June 21, 2019, the Supreme Court finally <\/span><span id=\"E1020\" class=\"qowt-font8-Garamond\">corrects<\/span><span id=\"E1021\" class=\"qowt-font8-Garamond\"> the decision of the <\/span><span id=\"E1022\" class=\"qowt-font8-Garamond\">H<\/span><span id=\"E1023\" class=\"qowt-font8-Garamond\">igh <\/span><span id=\"E1024\" class=\"qowt-font8-Garamond\">C<\/span><span id=\"E1025\" class=\"qowt-font8-Garamond\">ourt of Navarra, declaring that yes, it was sexual assault, there was not consent, and convicts the accused of a <\/span><span id=\"E1026\" class=\"qowt-font8-Garamond\">continued<\/span><span id=\"E1027\" class=\"qowt-font8-Garamond\"> crime of rape with degrading treatment. This is a victory for the woman, who <\/span><span id=\"E1028\" class=\"qowt-font8-Garamond\">finally sees<\/span><span id=\"E1029\" class=\"qowt-font8-Garamond\"> an end to the painful journey she \u201cnever thought [she] would have to go through,\u201d <\/span><span id=\"E1030\" class=\"qowt-font8-Garamond\">making it possible <\/span><span id=\"E1031\" class=\"qowt-font8-Garamond\">for her <\/span><span id=\"E1032\" class=\"qowt-font8-Garamond\">to start moving on<\/span><span id=\"E1033\" class=\"qowt-font8-Garamond\"> with her life. However, once the sentence is made public, the media goes back to its sensationalist tone to cover a series of sexual assaults with chemical submission that take place over the summer. The COVID-19 pandemic, the creation of the Ministry of Equality, and Irene Montero\u2019s mandate are upon us. The die is cast.<\/span><\/p>\n<h3><\/h3>\n<h3 id=\"E1036\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span style=\"color: #ff1764;\"><span id=\"E1037\" class=\"qowt-font8-Garamond\">2020-2023<\/span><span id=\"E1038\" class=\"qowt-font8-Garamond\">: <\/span><span id=\"E1039\" class=\"qowt-font8-Garamond\">The Law and Punishments<\/span><\/span><\/h3>\n<p id=\"E1042\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1043\" class=\"qowt-font8-Garamond\">The massiveness of <\/span><span id=\"E1044\" class=\"qowt-font8-Garamond\">the feminist movement everywhere, combined with the pressure of public opinion, made it impossible to avoid the issue of sexual violence. The protests since the autumn of 2017 had been so thunderous that no political party could look the other way. <\/span><\/p>\n<p id=\"E1047\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1048\" class=\"qowt-font8-Garamond\">Back in the spring of 2018, the then minister and spokesperson of the Partido Popular Government, \u00cd\u00f1igo M\u00e9ndez de Vigo, had been forced to make a statement after the Navarrese Provincial Court released its controversial sentence. In the press conference, he announced that the highest advisory board of the Ministry of Justice would study the possibility of reviewing the classification of sexual crimes in the <\/span><span id=\"E1049\" class=\"qowt-font8-Garamond\">Penal<\/span><span id=\"E1050\" class=\"qowt-font8-Garamond\"> Code.<\/span><\/p>\n<p id=\"E1053\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1054\" class=\"qowt-font8-Garamond\">In June 2018, during Pedro S\u00e1nchez\u2019s first term, three <\/span><span id=\"E1055\" class=\"qowt-font8-Garamond\">motions<\/span><span id=\"E1056\" class=\"qowt-font8-Garamond\"> about sexual violence had been registered: two non-law motions by the parliamentary group Ciudadanos and one law motion by the confederal parliamentary group Unidas Podemos-En Com\u00fa Podem-En Marea. The latter would eventually become Organic Law 10\/2022, on September 6, of <\/span><span id=\"E1057\" class=\"qowt-font8-Garamond\">the<\/span><span id=\"E1058\" class=\"qowt-font8-Garamond\"> Comprehensive Guarantee of Sexual Freedom. <\/span><span id=\"E1059\" class=\"qowt-font8-Garamond\">The law<\/span><span id=\"E1060\" class=\"qowt-font8-Garamond\"> brought together some of the main demands of the feminist movement, identifying sexual violence as a manifestation of sexist violence and mentioning the importance of \u201cfree, revocable consent for specific practices.\u201d<\/span><span id=\"E1061\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1063\" class=\"qowt-font8-Garamond\"> Thus, we can see the extent to which sexual violence was being prioritized at the moment when the coalition between the Partido Socialist and Podemos comes to power and, in 2020, reappoints Pedro S\u00e1nchez as president and <\/span><span id=\"E1064\" class=\"qowt-font8-Garamond\">names<\/span><span id=\"E1065\" class=\"qowt-font8-Garamond\"> Irene Montero Minister of Equality. <\/span><\/p>\n<p id=\"E1068\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1069\" class=\"qowt-font8-Garamond\">On March 3, 2020, five days before International Working Women\u2019s Day, when there are calls for feminist demonstrations across the country, the Council of Ministers approve<\/span><span id=\"E1070\" class=\"qowt-font8-Garamond\">s<\/span><span id=\"E1071\" class=\"qowt-font8-Garamond\"> the preliminary draft of the Organic Law of the Comprehensive Guarantee of Sexual Freedom, based on the proposal by Unidas Podemos, En <\/span><span id=\"E1072\" class=\"qowt-font8-Garamond\">Com\u00fa Podem, and En Marea in <\/span><span class=\"qowt-font8-Garamond\">2018, incorporating reform of the Penal Code.<\/span><span id=\"E1073\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1075\" class=\"qowt-font8-Garamond\"> It is quite possible that the fate of this bill would have been very different if not for a global event that turned the world upside down, irremediably altering the correlation of forces between the feminist movement and reactionary powers.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E1078\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1079\" class=\"qowt-font8-Garamond\">Let\u2019s go <\/span><span id=\"E1080\" class=\"qowt-font8-Garamond\">step by step<\/span><span id=\"E1081\" class=\"qowt-font8-Garamond\">. Since early 2020, <\/span><span id=\"E1082\" class=\"qowt-font8-Garamond\">media<\/span><span id=\"E1083\" class=\"qowt-font8-Garamond\"> outlets around the world <\/span><span id=\"E1084\" class=\"qowt-font8-Garamond\">have been reporting on a previous unknown illness caused by a coronavirus, COVID-19. <\/span><span id=\"E1085\" class=\"qowt-font8-Garamond\">The news trickles in gradually at first until it ends up flooding everything <\/span><span id=\"E1086\" class=\"qowt-font8-Garamond\">and the full extent of the issue begins to be seen. On March 8, 2020, thousands of women and sexual dissidents happily attend the feminist rallies held everywhere. At that time, the sickness is considered a minor issue, the message is to stay calm, and, in Spain, there are no restrictions or recommendations. The feminist demonstrations are not the only public gathering in those days: like any year around that date, a multitude of public events and celebrations of all kinds are authorized.<\/span><span id=\"E1087\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><\/p>\n<p id=\"E1091\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1092\" class=\"qowt-font8-Garamond\">However, with the accelerated spread of COVID-19 in <\/span><span id=\"E1093\" class=\"qowt-font8-Garamond\">the Spanish State<\/span><span id=\"E1094\" class=\"qowt-font8-Garamond\"> during the second week of March, the media, encouraged by the far right and other reactionary forces, <\/span><span id=\"E1095\" class=\"qowt-font8-Garamond\">identifies<\/span><span id=\"E1096\" class=\"qowt-font8-Garamond\"> the feminist movement as the perfect target on which to lay the blame for all of society\u2019s ills.<\/span><span id=\"E1097\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E1098\" class=\"qowt-font8-Garamond\">If, at other times, they minimized attendance <\/span><span id=\"E1099\" class=\"qowt-font8-Garamond\">at<\/span><span id=\"E1100\" class=\"qowt-font8-Garamond\"> March 8 demonstrations, in this case, <\/span><span id=\"E1101\" class=\"qowt-font8-Garamond\">the media<\/span><span id=\"E1102\" class=\"qowt-font8-Garamond\"> emphasizes their massiveness to blame feminism in general and the <\/span><span id=\"E1103\" class=\"qowt-font8-Garamond\">organizers<\/span><span id=\"E1104\" class=\"qowt-font8-Garamond\"> in particular for the deaths from COVID-19.<\/span><span id=\"E1105\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1107\" class=\"qowt-font8-Garamond\"> <\/span><\/p>\n<p id=\"E1110\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1111\" class=\"qowt-font8-Garamond\">The attack does not only come from the outside. That same March 8, 2020, the <\/span><span id=\"E1112\" class=\"qowt-font8-Garamond\">rift<\/span><span id=\"E1113\" class=\"qowt-font8-Garamond\"> that had been opening up in <\/span><span id=\"E1114\" class=\"qowt-font8-Garamond\">a seemingly cohesive feminist movement ends up breaking it apart. The block advocating for the abolition of prostitution aggressively storms the front of the demonstration in Madrid, provoking a violent clash that leads to an irreversible break. There is hardly any opportunity to collectively elaborate the commotion produced by that confrontation: the COVID-19 confinement empties the streets and assemblies for months. Also citing the \u201crisk of COVID-19 infection,\u201d the <\/span><span id=\"E1115\" class=\"qowt-font8-Garamond\">Government of Madrid<\/span><span id=\"E1116\" class=\"qowt-font8-Garamond\"> prohibits the 102 gatherings scheduled in the Community of Madrid for March 8, 2021. This does not stop feminists from taking to the streets in <\/span><span id=\"E1117\" class=\"qowt-font8-Garamond\">a decentralized way, neighborhood by neighborhood, but it does cause tension<\/span><span id=\"E1118\" class=\"qowt-font8-Garamond\">.<\/span><span id=\"E1119\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1121\" class=\"qowt-font8-Garamond\"> The mainstream media takes advantage of this rarefied atmosphere to interfere. It presents a caricature of the debates taking place within the movement: on the one side, an \u201cenlightened,\u201d \u201csensible\u201d feminism that places Woman (<\/span><span id=\"E1122\" class=\"qowt-font8-Garamond\">a capitalized, universal category<\/span><span id=\"E1123\" class=\"qowt-font8-Garamond\">) in the center; on the other, a feminism \u201cmanipulated by the queer lobby\u201d and so-called <\/span><span id=\"E1124\" class=\"qowt-font8-Garamond\">gender ideology<\/span><span id=\"E1125\" class=\"qowt-font8-Garamond\">. <\/span><\/p>\n<p id=\"E1128\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1129\" class=\"qowt-font8-Garamond\">The so-called \u201c<\/span><span id=\"E1130\" class=\"qowt-font8-Garamond\">Only <\/span><span id=\"E1131\" class=\"qowt-font8-Garamond\">Yes is Yes\u201d law, drafted by Montero\u2019s team, goes into effect on October 7, 2022, a few months before the World Health Organization declares the end of the health emergency and the COVID-19 pandemic. This law, which equates sexual abuse and assault, is a victory for the organized feminist movement that, pointing to the <\/span><span id=\"E1132\" class=\"qowt-font8-Garamond\">sexism<\/span><span id=\"E1133\" class=\"qowt-font8-Garamond\"> of the sentences issued by the Provincial Court of Navarra and the Navarra Higher Court of Justice, placed consent in the center as the only limit to sexual freedom: even if there is not violence or intimidation, any time there is not consent, it is assault. Violence or intimidation would be an aggravating, but not the fundamental, factor. \u201cOnly <\/span><span id=\"E1134\" class=\"qowt-font8-Garamond\">y<\/span><span id=\"E1135\" class=\"qowt-font8-Garamond\">es is <\/span><span id=\"E1136\" class=\"qowt-font8-Garamond\">y<\/span><span id=\"E1137\" class=\"qowt-font8-Garamond\">es\u201d thus represents a paradigm shift: consent is in the center. <\/span><\/p>\n<p id=\"E1140\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1141\" class=\"qowt-font8-Garamond\">The law introduces other important modifications. The text proposes a perspective of prevention and comprehensive care for women and provides for the creation of resources <\/span><span class=\"qowt-font8-Garamond\">such as 24 hour crisis centers. <\/span><span id=\"E1142\" class=\"qowt-font8-Garamond\">A<\/span><span id=\"E1143\" class=\"qowt-font8-Garamond\">rticle 35, defines these centers as \u201cservices that provide psychological, legal, and social care. Following criteria of constant attention and urgent action, they will provide support and assistance in crisis situations for victims, <\/span><span id=\"E1144\" class=\"qowt-font8-Garamond\">their family members, and those around them.\u201d<\/span><span id=\"E1145\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1147\" class=\"qowt-font8-Garamond\"> It also declares that access to the rights guaranteed by the law do not require filing a police report.<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E1150\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1151\" class=\"qowt-font8-Garamond\">The autonomous feminist movement, while recognizing that the law is a victory for the mobilizations that have pushed for it, still raises strong critiques. There are two important objections: on the one hand, the law does not guarantee migrant women in irregular administrative situations the right to <\/span><span id=\"E1152\" class=\"qowt-font8-Garamond\">report<\/span><span id=\"E1153\" class=\"qowt-font8-Garamond\"> a crime and to justice. If they file a report and are not able to demonstrate assault in the <\/span><span id=\"E1154\" class=\"qowt-font8-Garamond\">legal<\/span><span id=\"E1155\" class=\"qowt-font8-Garamond\"> process, not only does the assault go unpunished, but they also risk expulsion. <\/span><span id=\"E1156\" class=\"qowt-font8-Garamond\">For this not to be the case, the Law <\/span><span id=\"E1157\" class=\"qowt-font8-Garamond\">on<\/span><span id=\"E1158\" class=\"qowt-font8-Garamond\"> Foreign Persons would need to be modified,<\/span><span id=\"E1159\" class=\"qowt-font8-Garamond\"> as the autonomous antiracist feminist movement has been demanding for years. On the other hand, the bill recovers the locative third party, that is, the persecution of those provide spaces for the \u201cexercise of prostitution.\u201d Under the discourse of the abolition of prostitution, what this clause does is makes it difficult for sex workers to even be able to rent a pla<\/span><span id=\"E1160\" class=\"qowt-font8-Garamond\">c<\/span><span id=\"E1161\" class=\"qowt-font8-Garamond\">e to live and criminalizes their whole surroundings. The mobilization of sex workers and allied feminists, as well as lobbying work and the positioning of parties outside the Government, was able to eliminate the third party locative from the bill, although not the penalization of advertising. However, equal access to justice for all is still excluded from the final text: <\/span><span id=\"E1162\" class=\"qowt-font8-Garamond\">undocumented<\/span><span id=\"E1163\" class=\"qowt-font8-Garamond\"> migrant women will have to initiate the whole process with the threat of deportation hanging over their heads. <\/span><\/p>\n<p id=\"E1166\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1167\" class=\"qowt-font8-Garamond\">Since the law has gone into effect, the right wing media has unleashed an all out war against the Ministry of Equality, calling the text \u201c<\/span><span id=\"E1168\" class=\"qowt-font8-Garamond\">botched job<\/span><span id=\"E1169\" class=\"qowt-font8-Garamond\">.\u201d Given that the law addresses all forms of sexual crimes as modalities of the same crime of assault and the range of punishments varied, certain magistrates <\/span><span id=\"E1170\" class=\"qowt-font8-Garamond\">have taken<\/span><span id=\"E1171\" class=\"qowt-font8-Garamond\"> advantage of the occasion to review the sentences of a handful of people convicted for sexual crimes and free some of them. This has added fuel to the fire of the media machine, which indulges in headlines such as \u201cThe \u2018only yes is yes\u2019 law has already benefited 978 sexual aggressors and freed 104 of them,\u201d in the newspaper <\/span><span id=\"E1172\" class=\"qowt-font8-Garamond\">El Mundo<\/span><span id=\"E1173\" class=\"qowt-font8-Garamond\"> in April 2023. Fuel and more fuel to feed the fear, insecurity, and sexual terror that are so useful for restricting women\u2019s autonomy. <\/span><\/p>\n<p id=\"E1176\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1177\" class=\"qowt-font8-Garamond\">Happy to be able to present itself as the serious party in opposition to the \u201cradical Podemos supporters,\u201d the PSOE rushes in to reform the law. Pilar Llop, Minister of Justice at the time, affirms on a radio program in February 2023 that \u201cit is very easy for the victim to prove that there was violence, just one wound is enough.\u201d<\/span><span id=\"E1178\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1180\" class=\"qowt-font8-Garamond\"> The proposed reform maintains a single crime of sexual assault, but it introduces <\/span><span id=\"E1181\" class=\"qowt-font8-Garamond\">subtypes<\/span><span id=\"E1182\" class=\"qowt-font8-Garamond\"> to differentiate between aggression with violence and intimidation and that without. Thus, the main demand of the feminist mobilizations is ignored: preventing <\/span><span id=\"E1183\" class=\"qowt-font8-Garamond\">women who are<\/span><span id=\"E1184\" class=\"qowt-font8-Garamond\"> victims of sexual assault from having to prove in court how much they resisted. Once again everything revolves around sentences and prison, the causes of violence and women\u2019s concrete situation disappear from the public debate. The punitivist element, <\/span><span id=\"E1185\" class=\"qowt-font8-Garamond\">encouraged<\/span><span id=\"E1186\" class=\"qowt-font8-Garamond\"> by the media <\/span><span id=\"E1187\" class=\"qowt-font8-Garamond\">siege<\/span><span id=\"E1188\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E1189\" class=\"qowt-font8-Garamond\">against<\/span><span id=\"E1190\" class=\"qowt-font8-Garamond\"> autonomous feminism, strengthens its position. The reform proposed by the PSOE is ultimately approved in the Senate on April 26, 2023. A few months later, following elections, Irene Montero leaves the Equality Ministry, which returns to the hands of the PSOE. The first <\/span><span id=\"E1191\" class=\"qowt-font8-Garamond\">initiative<\/span><span id=\"E1192\" class=\"qowt-font8-Garamond\"> by the new minister, Ana Redondo <\/span><span id=\"E1193\" class=\"qowt-font8-Garamond\">Garc\u00eda, is a bill to criminalize prostitution, which, fortunately, is not approved.<\/span><span id=\"E1194\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1196\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E1197\" class=\"qowt-font8-Garamond\"> <\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"pageBorders\" class=\"style-scope qowt-page\" contenteditable=\"false\"><\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<h3 id=\"E1200\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1201\" class=\"qowt-font8-Garamond\" style=\"color: #ff1764;\">2024: Ways out of an Impasse<\/span><\/h3>\n<p id=\"E1204\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1205\" class=\"qowt-font8-Garamond\">Here<\/span><span id=\"E1206\" class=\"qowt-font8-Garamond\"> we can return to a question that feminist <\/span><span id=\"E1207\" class=\"qowt-font8-Garamond\">lawyer<\/span><span id=\"E1208\" class=\"qowt-font8-Garamond\"> Laia Serra <\/span><span id=\"E1209\" class=\"qowt-font8-Garamond\">had already asked<\/span><span id=\"E1210\" class=\"qowt-font8-Garamond\"> in 2018 in the context of the debate over life imprisonment rekindled by Diana Quer\u2019s father: \u201cHow can we, as feminists, position ourselves between solidarity with the victims and survivors and the State\u2019s punitive drift? To situate ourselves, it is useful to delve into the phenomenon of \u2018punitive populism\u2019: a political and penal formula that can be contextualized in the expansion of neoliberalism, the breakdown of the welfare state, and the rise of neoconservativism. \u2018Punitive populism\u2019 is defined as the manipulative and reactionary ideology of the state <\/span><span id=\"E1211\" class=\"qowt-font8-Garamond\">that exploits<\/span><span id=\"E1212\" class=\"qowt-font8-Garamond\"> the collective\u2019s insecurities to neutralize certain social debates and selectively criminalize certain behaviors and social sectors in order to limit fundamental freedoms.\u201d<\/span><span id=\"E1213\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1215\" class=\"qowt-font8-Garamond\"> <\/span><\/p>\n<p id=\"E1218\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1219\" class=\"qowt-font8-Garamond\">This framework helps us understand how it is possible that punitivism, rather than consent, has acquired a central role in the public debate over the <\/span><span id=\"E1220\" class=\"qowt-font8-Garamond\">only yes is yes<\/span><span id=\"E1221\" class=\"qowt-font8-Garamond\"> law. Its success is ensured by the <\/span><span id=\"E1222\" class=\"qowt-font8-Garamond\">ability of the media-based right wing<\/span><span id=\"E1223\" class=\"qowt-font8-Garamond\"> to appeal to emotions over objective data and facts and to offer apparently quick and easy solutions in the face of complex phenomena. Its result is not only the limitation of fundamental rights and freedoms, but also the reinforcement of state authoritarianism. <\/span><\/p>\n<p id=\"E1226\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1227\" class=\"qowt-font8-Garamond\">On the other hand, as the lawyer Violeta Assiego reminds us, \u201cthere is something in the criminal justice system itself that, even <\/span><span id=\"E1228\" class=\"qowt-font8-Garamond\">with<\/span><span id=\"E1229\" class=\"qowt-font8-Garamond\"> the strongest sentences, <\/span><span id=\"E1230\" class=\"qowt-font8-Garamond\">those<\/span><span id=\"E1231\" class=\"qowt-font8-Garamond\"> most proportionate to the seriousness of the acts, continues protecting the impunity with which thousands and thousands of men exercise violence against women, sexual violence, physical, and psychological violence.\u201d<\/span><span id=\"E1232\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1234\" class=\"qowt-font8-Garamond\"> For autonomous feminists, that is, for those of us who have <\/span><span id=\"E1235\" class=\"qowt-font8-Garamond\">organized<\/span><span id=\"E1236\" class=\"qowt-font8-Garamond\"> the feminist strikes, neighborhood assemblies, <\/span><span id=\"E1237\" class=\"qowt-font8-Garamond\">and <\/span><span id=\"E1238\" class=\"qowt-font8-Garamond\">everyday work on the streets, the issue was never about punishment. But the media <\/span><span id=\"E1239\" class=\"qowt-font8-Garamond\">siege<\/span><span id=\"E1240\" class=\"qowt-font8-Garamond\"> that was <\/span><span id=\"E1241\" class=\"qowt-font8-Garamond\">constructed<\/span><span id=\"E1242\" class=\"qowt-font8-Garamond\"> over months through the <\/span><span id=\"E1243\" class=\"qowt-font8-Garamond\">trickle<\/span><span id=\"E1244\" class=\"qowt-font8-Garamond\"> of information about the review of sentences, some reductions of sentences and the release of some aggressors, <\/span><span id=\"E1245\" class=\"qowt-font8-Garamond\">along with fewer<\/span><span id=\"E1246\" class=\"qowt-font8-Garamond\"> mobilizations in the streets, produced an effect of terror in the collective imaginary that justified the increase in sentences, but not the guarantee of rights and protections for women. Thus, the <\/span><span id=\"E1247\" class=\"qowt-font8-Garamond\">media right<\/span><span id=\"E1248\" class=\"qowt-font8-Garamond\"> and patriarchal <\/span><span id=\"E1249\" class=\"qowt-font8-Garamond\">backlash<\/span><span id=\"E1250\" class=\"qowt-font8-Garamond\"> took aim and we were left in an impasse in which the feminist and anti-punitivist justice that we defended was silenced. <\/span><\/p>\n<p id=\"E1253\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1254\" class=\"qowt-font8-Garamond\">We know that we are witnessing the <\/span><span id=\"E1255\" class=\"qowt-font8-Garamond\">instrumentalization<\/span><span id=\"E1256\" class=\"qowt-font8-Garamond\"> of women\u2019s rights and the struggle against sexist violences to legitimize repressive policies. This is not new: <\/span><span id=\"E1257\" class=\"qowt-font8-Garamond\">securo-feminism<\/span><span id=\"E1258\" class=\"qowt-font8-Garamond\">, as Rafia Zakaria calls it, has been legitimizing neoliberal policies and the violence of war on bodies of people in the Global South in the name of women\u2019s rights for decades.<\/span><span id=\"E1259\" class=\"qowt-font8-Garamond qowt-stl-FootnoteAnchor\"><\/span><span id=\"E1261\" class=\"qowt-font8-Garamond\"> <\/span><span id=\"E1262\" class=\"qowt-font8-Garamond\">However<\/span><span id=\"E1263\" class=\"qowt-font8-Garamond\">, patriarchal impunity forces us to imagine feminist horizons of justice. The issue goes beyond debates <\/span><span id=\"E1264\" class=\"qowt-font8-Garamond\">over<\/span><span id=\"E1265\" class=\"qowt-font8-Garamond\"> the law. We must not forget that it was our <\/span><span id=\"E1266\" class=\"qowt-font8-Garamond\">drive<\/span><span id=\"E1267\" class=\"qowt-font8-Garamond\">, the mobilizations that we were able to build <\/span><span id=\"E1268\" class=\"qowt-font8-Garamond\">on<\/span><span id=\"E1269\" class=\"qowt-font8-Garamond\"> the streets and the narratives that we launched, that put patriarchal justice on the ropes and forced the political parties that made up the coalition government between 2020 and 2023 to take note and do something about it. Today this <\/span><span id=\"E1270\" class=\"qowt-font8-Garamond\">push is facing a patriarchal backlash fueled by the <\/span><span id=\"E1271\" class=\"qowt-font8-Garamond\">media right<\/span><span id=\"E1272\" class=\"qowt-font8-Garamond\">, that also feeds discourses on the left about \u201cthe excesses of feminism.\u201d<\/span><\/p>\n<p id=\"E1275\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1276\" class=\"qowt-font8-Garamond\">While it is true that the rhetoric of sexual terror has had a major impact on public opinion <\/span><span class=\"qowt-font8-Garamond\">and in the dispute over the political narrative, it is also true that we have been able to create anti-punitivist narratives against a securitarian politics that seeks to control women. In this response, the autonomous feminist movement has always made it clear that prison is not the solution, <\/span><span id=\"E1277\" class=\"qowt-font8-Garamond\">putting<\/span><span id=\"E1278\" class=\"qowt-font8-Garamond\"> forth a multifaceted proposal that is not focused on punishments, but rather on the meaning of the word \u201cjustice.\u201d<\/span><\/p>\n<\/div>\n<\/div>\n<div id=\"contentsContainer\" class=\"style-scope qowt-page\">\n<div id=\"contents\" class=\"style-scope qowt-page\">\n<p id=\"E1281\" class=\"qowt-stl-Normal x-scope qowt-word-para-1\"><span id=\"E1282\" class=\"qowt-font8-Garamond\">We know that the feminist justice we aspire to must be intersectional, it must center assaulted women and their needs, and it must do so with measures that guarantee truth, justice, and reparations, which should be accompanied by responsiblization and the guarantee of non-repetition. We know that we <\/span><span id=\"E1283\" class=\"qowt-font8-Garamond\">need<\/span><span id=\"E1284\" class=\"qowt-font8-Garamond\"> measures of prevention, comprehensive care, access to legal processes that are not revictimizing, as well as policies that target the social structures that generate violences. We also need <\/span><span id=\"E1285\" class=\"qowt-font8-Garamond\">transformative community-based<\/span><span id=\"E1286\" class=\"qowt-font8-Garamond\"> dynamics capable of avoiding revictimization and breaking the cycle of reproduction of violence, as well as forms of self-defense, understood not as an individual, but rather a collective, practice, <\/span><span id=\"E1287\" class=\"qowt-font8-Garamond\">and<\/span><span id=\"E1288\" class=\"qowt-font8-Garamond\"> the concrete transformation of <\/span><span id=\"E1289\" class=\"qowt-font8-Garamond\">ways<\/span><span id=\"E1290\" class=\"qowt-font8-Garamond\"> of occupying public space and weaving networks that protect life and make it safer. We believe that this <\/span><span id=\"E1291\" class=\"qowt-font8-Garamond\">multilayered strategy is the way to overcome fear, step firmly, break free from the quagmire, and emerge from this impasse. <\/span><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>1.
